Ausz Global Privacy Policy

Please read this Privacy Policy. This Privacy Policy explains and outlines AUSZ Global’s personal information management practices for all aspects of AUSZ Global business in Australia.


 

 

1.                Definitions

1.1.           AUSZ Global means AUSZ Global Pty Ltd (ACN 638 227 684).

1.2.           AUSZ Global App/ AG Driver App means an application created by AUSZ Global to provide a platform for the Driver to receive and accept requests for Chauffeur Service.

1.3.           Chauffeur Service means the chauffeur service provided by the Driver as defined in the Terms and Conditions for AUSZ Global’s driver.

1.4.           Client means a person who uses the AUSZ Global App or Website to request Chauffeur Service (whether or not it is registered under the AUSZ Global App or Website).

1.5.           Driver means the driver who uses the AUSZ Global App or Website to provide the Chauffeur Service to the Client (whether or not it is registered under the AUSZ Global App or Website).

1.6.           Personal Information means the Personal Information as defined in clause 4.2 of this Privacy Policy.

1.7.           Privacy Act means the Privacy Act 1988 (Cth) as varied from time to time.

1.8.           Privacy Policy means this privacy policy (as may be varied from time to time).

1.9.           Services means the services provided by the AUSZ Global App, such as but not limited to, connecting the Chauffeur Service between the Drivers and the Client.

1.10.       User means any user of the AUSZ Global App or Website (whether or not it is registered under the AUSZ Global App or Website) and/or any user of the Services provided by AUSZ Global and/or any person who will contact and/or provide Personal Information to AUSZ Global.

1.11.       Website means AUSZ Global’s website, http://www.auszglobal.com.au and any of its subpages, driver’s portals and any webpages as may be varied from time to time by AUSZ Global.

2.                Interpretations

2.1.           In this Privacy Policy unless the contrary intention appears:

2.1.1        an obligation or a liability assumed by, or a right conferred on, two or more parties binds or benefits all of them jointly and each of them severally;

2.1.2        the expression person includes an individual, the estate of an individual, a corporation, an authority, an association or a joint venture (whether incorporated or unincorporated), a partnership and a trust;

2.1.3        a reference to any party includes that party's executors, administrators, successors and permitted assigns, including any person taking by way of novation and, in the case of the trustee, includes any substituted or additional trustee;

2.1.4        a reference to any document (including this agreement) is to that document as varied, novated, ratified or replaced from time to time;

2.1.5        a reference to any statute or any statutory provision includes any statutory modification or re-enactment of it or any statutory provision substituted for it, and all ordinances, by-laws, regulations, rules and statutory instruments (however described) issued under it;

2.1.6        words importing the singular include the plural (and vice versa);

2.1.7        words importing a gender include every other gender;

2.1.8        references to parties, clauses, schedules, exhibits or annexures are references to Parties, clauses, schedules, exhibits and annexures to or of this agreement, and a reference to this agreement includes any schedule, exhibit or annexure to this agreement;

2.1.9        where a word or phrase is given a defined meaning, any other part of speech or grammatical form of that word or phrase has a corresponding meaning;

2.1.10     the word 'includes' in any form is not a word of limitation; and

2.1.11     a reference to $ or dollar is to Australian currency.

3.                Introduction

3.1.           AUSZ Global and its related bodies corporate (including any overseas subsidiaries or related company) acknowledge and agree that it will collect personal information and may disclose such information to other parties by the Australian Privacy Principles contained in the Privacy Act.

3.2.           This Privacy Policy sets out how AUSZ Global collects information from the User and how the User may request access to and an amendment to their Personal Information.

3.3.           This Privacy Policy applies to any User and to anyone else who contacts AUSZ Global or its related bodies corporate or anyone who submits any information to AUSZ Global.


4.                Collection of Personal Information

4.1.           AUSZ Global collects Personal Information from the User to enable AUSZ Global or AUSZ Global App to provide Services and specific information to the User to comply with AUSZ Global legal and regulatory obligations (such as but not limited to special offers, update of terms and conditions etc).

4.2.           In this Privacy Policy, Personal Information means the information provided by the User (including but not limited to) to the following:

4.2.1        personal details of the User, being:

4.2.1.1      full name of the User;

4.2.1.2      gender;

4.2.1.3      age;

4.2.1.4      user’s account username;

4.2.1.5      account login details and passwords

4.2.1.6      address (including email address and website address);

4.2.1.7      phone number;

4.2.1.8      User’s emergency contact details;

4.2.1.9      User’s payment details (as stated in clause 4.2.4);

4.2.2        details of the User’s account preference of the AUSZ Global App, such as the “Preferred Driver” function which may include in the AUSZ Global App;

4.2.3        If the User is a Driver, the following information may be collected by AUSZ Global (including but not limited to):

4.2.3.1      the location of the provision of the Chauffeur Services;

4.2.3.2      the identification of the Driver;

4.2.3.3      the Driver’s criminal history and background checks;

4.2.3.4      the taxation details of the Driver (such as ABN);

4.2.3.5      the driver’s government or regulatory identification details (such as drivers licence details);

4.2.3.6      the details of the Driver’s vehicle and/or its insurance details;

4.2.3.7      any other information which is required by law or regulations to prove the Driver’s suitability as a driver to provide the Chauffeur Services, such as but not limited to the accreditation or any approval required by its jurisdiction.

4.2.4        the information collected and held by the payment system of the AUSZ Global App or any third parties (including credit card or debit card details).

4.2.5        the information relating to any complaints or ratings or compliment which was made by the User or against the User, including but not limited to any recording of any calls.

4.2.6        the information indicating how, when, what and where the User had used the Services provided by the AUSZ Global App or access to the AUSZ Global App, such us the geo-location information, departure and destination information, trip duration and distance travelled.

4.2.7        the information of other individuals such as family members, referrals of the User.

4.2.8        the information accessible from the use of the Website or AUSZ Global App in which AUSZ Global may have an interest (such as messages for the purposes of issuing and receiving one-time passwords or pins and other device verification) and device-related or device-generated personal information. The latter might include the User’s device details, device IDs, location, network connections, network access and communication and session data.

4.2.9        if the User uses any social medial accounts in connection with the AUSZ Global App or Website, the details of the User’s social media’s account, for example, the User shares their trip details of the Services provided by AUSZ Global through social media.

5.                Purpose of the collection of Personal Information

5.1.           AUSZ Global collects and uses the User’s Personal Information for its business operations and activities, including but not limited to:

5.1.1        communication with the User for the provision of the Services;

5.1.2        to facilitate communications between the Driver and the Client in relation to the provision of the Chauffeur Services;

5.1.3        direct marketing such as notifying the User of any information or content;

5.1.4        safety and security purposes, such as but not limited to verifying the User’s identity;

5.1.5        process and facilitate the payment for goods and services as required by any relevant legislations and regulations.

5.1.6        provide administrative and management support services to the User;

5.1.7        research and development purposes to improve the goods and services of the AUSZ Global App, in respect of safety and security, fraudulent prevention payment;

5.1.8        provide and conduct promotions and advertising campaigns;

5.1.9        assist in dispute resolution, investigation of complaints and enquiries;

5.1.10     fulfil AUSZ Global’s obligations under this Privacy Policy or exercise AUSZ Global’s rights in connection with any legal proceedings;

5.1.11     report to any regulatory authorities and governments bodies as required by any relevant law and regulations.

5.2.           AUSZ Global may at its sole and absolute discretion (where permitted by law) anonymise or aggregate the User’s Personal Information for any purposes which are within reasonable expectations (for example, conducting analysis, preferences and patterns of the User of AUSZ Global App) or for any reasons permitted by law.

5.3.           The User acknowledges and agrees that AUSZ Global may share its Personal Information (whether or not it is anonymised) or aggregate information data collected by any AUSZ Global’s trusted partners to conduct any analysis or marketing which the User may be interested in or may be relevant to the User’s interest (even after the User ceases use of the AUSZ Global App).

5.4.           AUSZ Global may disclose the User’s Personal Information to any AUSZ Global related entities and/or subsidiaries and/or business partners to assist AUSZ Global in the provision of Services on behalf of AUSZ Global. These related entities and/or subsidiaries and/or business partners may locate outside of Australia.

5.5.           In the event of an incident or emergency, AUSZ Global may disclose your Personal Information to the User’s family members or emergency contacts.

6.                Methods of collection of Personal Information

6.1.           AUSZ Global may collect the User’s Personal Information when the User undertakes the following activities:

6.1.1        the User communicates with AUSZ Global online or through the Website or AUSZ Global App;

6.1.2        the User is involved in AUSZ Global’s promotions, competitions, testimonials and/or surveys;

6.1.3        the User voluntarily discloses its Personal Information to AUSZ Global or its employees or contractors through its Website or AUSZ Global App.

Cookies

6.2.           The User acknowledges and agrees that AUSZ Global may use cookies and other identification technologies on AUSZ Global App or its Website or any online advertisements for the purposes of describing this Privacy Policy.

6.3.           The User may change its browser’s cookies preference on its web browser or its devices. 6.4.           AUSZ Global may collect the User’s Personal Information from other suppliers who, in common with AUSZ Global, have a relationship with AUSZ Global or the User or have information about the User (such as social media). For example, AUSZ Global’s contractors and other providers may provide payment processing services, fraud management, marketing, data analytics and identity verification and background checks authorities.

6.5.           AUSZ Global holds the User’s Personal Information in its servers and other computer systems (which may be in overseas). These servers and computer systems may be operated by AUSZ Global or its contractors or its service providers. AUSZ Global must at all time use its reasonable endeavour to secure all the User’s Personal Information to minimise the risks of unauthorised access or loss or misuse or wrongful alteration of the Personal Information.

7.                Direct Marketing

7.1.           AUSZ Global may at anytime directly provide the User for any related transportation news, information, special offers from AUSZ Global and other business. The User acknowledges and agrees that it consents to AUSZ Global sending these information by the following methods, but not limited to:

7.1.1                   telemarketing;

7.1.2                   email;

7.1.3                   post;

7.1.4                   SMS; or

7.1.5                   other digital methods.

7.2.           AUSZ Global may disclose the User’s Personal Information to other third parties who offer products and services that may be of interest to the User. The User hereby acknowledges and agrees that it consents to receiving these types of direct marking and commercial electronic messages.

7.3.           The User may at any time opt out of AUSZ Global’s direct marketing services by contacting the staff of AUSZ Global on its Website. 

8.                Storage and Security

8.1.           AUSZ Global will and continue to use its reasonable endeavours to prevent any Personal Information, which is and will continue to be held by AUSZ Global, to be misused, interfered or lost, unauthorised accessed, modified or disclosed to the public or any party which is not authorised by AUSZ Global.

8.2.           AUSZ Global will and continues to use industry standard efforts to safeguard the confidentiality of the User’s Personal Information, such as firewalls, access control procedures, encryption and physical security to protect the privacy of the Personal Information.

8.3.           AUSZ Global limits its employees or contractors to access to the User’s Personal Information unless the employees or contractors require access to the Personal Information to provide products or services to the User or to AUSZ Global or in order to perform their jobs.

8.4.           The User acknowledges and agrees it will undertake the responsibility for all actions taken with its user ID and password. The User acknowledges and agrees that it must not provide or share or disclose its password to anyone. The account granted by AUSZ Global to the User is non-exclusive, non-sublicensable, non-assignable, non-transferrable.

8.5.           If the User detects or becomes aware of or ought reasonably to be aware of any unusual activities or any potential activities which may affect the functionality of the AUSZ Global App or its Website or affect the User’s Personal Information, the User must immediately notify AUSZ Global by the AUSZ Global App or its Website.

8.6.           Subject to clause 8, AUSZ Global may also charge a reasonable administrative fee for providing access to the User’s Personal Information, if AUSZ Global reasonably believes that the User’s request requires substantial effort provided by AUSZ Global.

9.                Links to other websites

9.1.           AUSZ Global App and the Website may contain links to other websites or web addresses of third parties and its servers. AUSZ Global will use its reasonable endeavours and take appropriate steps to publish links to any third-party service providers and the User may decide whether or not to access these links through AUSZ Global App or its Website.

9.2.           The User acknowledges and agrees that AUSZ Global is not and shall not be liable in relation to the accuracy, completeness, adequacy, reliability of any information, data, opinions, pictures, statements or suggestion provided by any third-party service.

10.             Social Media Use

10.1.       The User acknowledges and agrees that AUSZ Global App or its Website may be linked with other social media programs or websites or applications (Social Media App), for example but not limited to Facebook. The User must read the terms and conditions, privacy policies and any relevant statements or policies prior to accessing the Social Media App. The User acknowledges and agrees that the Social Media App may use or disclose its Personal Information or other information.

11.             Communications

11.1.       The User acknowledges and agrees that the AUSZ Global App allows the Driver and the Client to communicate with each other through the AUSZ Global App. If the User uses this functionality, AUSZ Global may record all communications (including but not limited to voice and text) made and received by the AUSZ Global App, for safety, monitoring and quality assurance purposes.

11.2.       The User hereby consents to AUSZ Global making such recordings under clause 11.


12.             Updating of Personal Information

12.1.       The User may request access to its Personal Information by notifying AUSZ Global in writing. If a User sends a written request to AUSZ Global, AUSZ Global may provide a copy of its Personal Information within 14 days upon receipt of the written request.

12.2.       The User may at anytime, delete its account by providing a written request to AUSZ Global. Pursuant to clause 12.2, AUSZ Global may retain the User’s Personal Information in the following circumstances:

12.2.1  there is an unresolved issue relating to the User’s account, such as an outstanding credit on its account or an unresolved claim or dispute; and/or

12.2.2     it is required by law that AUSZ Global must retain the Personal Information; and/or

12.2.3     at AUSZ Global sole and absolute discretion, the Personal Information is necessary for AUSZ Global’s is legitimate business interests, such as fraud prevention and safety and security reasons.

12.3.       If the User’s Personal Information is inaccurate or incorrect or incomplete or outdated (whether partly or whole), the User must use its best endeavours to amend or rectify its Personal Information by the AUSZ Global App or its Website immediately.

13.             Geo-location service

13.1.       The User acknowledges and agrees that if the User would like to use the AUSZ Global App, the User must allow AUSZ Global App to access the User’s geo-location through the AUSZ Global App. The User may change this setting on its device at any time.

13.2.       The User acknowledges and agrees that it consents and provides permission to allow AUSZ Global to obtain the User’s geo-location through IP address, GPS, and other sensors that provide necessary information for the provision of the Chauffeur Services.

14.             Amendments

14.1.       AUSZ Global may at any time make changes to this Privacy Policy without any notices. The amended version of the Privacy Policy will be made available on the Website and AUSZ Global App from time to time.

14.2.       If the User does not agree to the amended terms, the User should cease to use the Service provided by the AUSZ Global App. If the User continues to use the AUSZ Global App system or continues to use AUSZ Global App, the User is deemed to have accepted the amended terms and it must not make any objection or claims against to the amended Privacy Policy.

15.             Dispute Resolution and Investigation

15.1.       If the User has any concerns about its Personal Information, the User may contact AUSZ Global by the AUSZ Global App or the Website. Prior to providing the User’s Personal Information, AUSZ Global may require the User to provide proof of identity for security purposes.

15.2.       If a User makes a complaint about the breach of the privacy rules, the User may contact AUSZ Global and provide the details of the complaint in writing. AUSZ Global will use its reasonable endeavours to investigate the complaint and resolve it in a timely manner.

15.3.       Pursuant to clause 15.2, AUSZ Global may inform the complainant the outcome of the investigation in writing. If the complainant is not satisfied with the outcome of the investigation, the User may request the matter to be referred to the Office of the Australian Information Commissioner for further investigation.

16.             Child Policy

16.1.       Any person who is under 18 years old, is not eligible to use the AUSZ Global App. The User hereby warrants that it must not allow or provide any Personal Information of any person under 18 years old. For the avoidance of doubt, A person who is under 18 years old, must not use the AUSZ Global App even though it uses the AUSZ Global App in conjunction with or under the supervision of its parents or guardians.

17.             Miscellaneous

17.1.       Headings

17.1.1     The headings in this Privacy Policy are not part of it and do not affect its meaning.

17.2.       Entire agreement

17.2.1     When agreed, this Privacy Policy constitutes the entire agreement between the parties in relation to their subject matter.

17.3.       No Waiver

17.3.1     A party only waives a breach of this Privacy Policy if the waiver is given in writing signed by the other party or its authorised representative. A waiver is limited to the instance referred to in writing (or if no instance is referred to in the writing, to past breaches).

17.4.       Illegality

17.4.1     If any provision of this Privacy Policy is held invalid, unenforceable or illegal for any reason, the Privacy Policy will remain otherwise in full force apart from such provisions which will be deemed deleted.
